Obec do poplatku nezahŕňa náklady na zbernú nádobu na zmesový komunálny odpad. Nájomníci obecného bytového domu č.139 sú povinný zabezpečiť si nádoby na komunálny odpad.

MIESTNY POPLATOK ZA KOMUNÁLNE ODPADY A DROBNÉ STAVEBNÉ ODPADY. Poplatok sa platí za komunálne odpady a drobné stavebné odpady, ktoré vznikajú na území obce Martinček. Poplatok sa platí za: a) činnosti nakladania so zmesovým komunálnym odpadom, b) činnosti nakladania s biologicky rozložiteľným komunálnym odpadom, c) triedený zber zložiek komunálneho odpadu, na ktoré sa nevzťahuje rozšírená zodpovednosť výrobcov, d) náklady spôsobené nedôsledným triedením oddelene zbieraných zložiek komunálneho odpadu, na ktoré sa vzťahuje rozšírená zodpovednosť výrobcov, e) náklady presahujúce výšku obvyklých nákladov podľa osobitného predpisu.

Poplatok platí poplatník, ktorým je: a) fyzická osoba, ktorá má v obci trvalý pobyt alebo prechodný pobyt, alebo ktorá je na území obce oprávnená užívať alebo užíva byt, nebytový priestor, pozemnú stavbu, alebo jej časť, alebo objekt, ktorý nie je stavbou, alebo záhradu, vinicu, ovocný sad, trvalý trávny porast na iný účel ako na podnikanie, pozemok v zastavanom území obce okrem lesného pozemku a pozemku, ktorý je evidovaný v katastri nehnuteľností ako vodná plocha, b) právnická osoba, ktorá je oprávnená užívať alebo užíva nehnuteľnosť nachádzajúcu sa na území obce na iný účel ako na podnikanie, c) podnikateľ, ktorý je oprávnený užívať alebo užíva nehnuteľnosť nachádzajúcu sa na území obce na účel podnikania.

Sadzba poplatku od 1.1.2023. Správca dane určuje sadzbu poplatku za komunálne odpady a drobné stavebné odpady na obdobie jedného kalendárneho roka: pri zavedenom množstvovom zbere 0,040 € za 1 liter komunálnych odpadov alebo drobných stavebných odpadov, pri nezavedenom množstvovom zbere – paušálny 0,04109 € za osobu a kalendárny deň (t.j. 15,00 EUR za osobu a kalendárny rok). 0,050 € za kilogram drobných stavebných odpadov bez obsahu škodlivín a veľkoobjemových komunálnych odpadov. U právnických osôb a podnikateľov sa ukazovateľ dennej produkcie podľa § 79 ods. 4 zákona o miestnych daniach a poplatku vynásobí koeficientom s hodnotou 1.

Poplatková povinnosť: Podľa zákona č. 582/2004 Z.z. o miestnych daniach a miestnom poplatku, poplatková povinnosť vzniká dňom, keď nastane skutočnosť, ktorá je viazaná na poplatníka. Takouto skutočnosťou je nadobudnutie trvalého, prechodného pobytu v obci Martinček, nadobudnutie oprávnenia užívať nehnuteľnosť, alebo užívanie nehnuteľnosti. Poplatník má voči obci oznamovaciu povinnosť. Je povinný obci oznámiť vznik, zánik poplatkovej povinnosti, prípadne zmenu skutočností rozhodujúcich na vyrubenie poplatku.
